Liability
Legal Responsibility
This page explains the scope of AyoCheck disclaimers, messaging and network delay risks, third-party platform dependency, and the legal position that the service is not a medical or emergency system.
1. Important service position
AyoCheck is a reminder and coordination service. It is not a health monitor, vital-sign monitor, emergency rescue system, security service, medical judgment system, or emergency reporting platform.
If there is danger to life, injury, acute illness, missing contact, violence, fire, or any other emergency, you must contact local emergency services immediately rather than rely on AyoCheck alone.
2. Delay, failure, and interruption
Message delivery, button replies, notifications, and escalation flows may be delayed, fail, stop, repeat, or be missed because of network congestion, platform limits, third-party APIs, devices, account permissions, outages, maintenance, security incidents, or force majeure. AyoCheck currently uses pg_cron on a 5-minute schedule, so some notifications may inherently be delayed by up to 5 minutes.
To the maximum extent permitted by law, we do not guarantee outcomes and are not responsible for loss caused by those conditions. Any user-configured escalation delay adds more time before notifications are sent, and the service does not guarantee real-time delivery or response.
3. No continuous monitoring duty
We have no duty to continuously monitor any person’s safety, health, location, vital signs, reply status, or device status, and no duty to manually follow up on every missed reply event.
4. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, the service, delayed reminders, failed notifications, inaccurate data, platform issues, device failures, incorrect settings, or unread messages.
